1919, Baghdad Criminal Procedure Regulations
n.a., xi+37p+6-page index, n.p., n.d. (These regulations, issued on 15 Nov. 1918 by Lt. Gen. W.R. Marshall, Commander-in-Chief of the Mesopotamia
Expeditionary Force, became effective 1st Jan. 1919 and applied only within the Baghdad Wilayet. They were intended to apply to all subsequent criminal
trials, even those for which the offense occurred prior to 1 Jan. 1919. Only trials among Iraqi inhabitants were contemplated as being within the scope
of these regulations. Crimes committed by British soldiers, even if against Iraqis, and “war crimes and other offenses against the safety and welfare
of the British Army will continue to be tried by Courts Martial, unless the Military Authorities direct otherwise.” The regulations were based mainly
on the Sudan Criminal Procedure Code, which itself was based on the Indian Code, although a few provisions of Turkish criminal procedure are
included.)
